II. Qualification Requirements for Applicants
Meet the requirements stipulated in Article 22 of the Government Procurement Law of the People’s Republic of China: (1) Possess the capacity to independently assume civil liability; (2) Have a good commercial reputation and a sound financial accounting system; (3) Possess the equipment and professional technical capabilities necessary to perform the contract; (4) Maintain a good record of lawful payment of taxes and social security contributions; (5) Have no major violations of laws and regulations in business activities during the three years prior to participating in government procurement activities; (6) Other conditions prescribed by laws and administrative regulations, as well as any special requirements for this project: 1. Bidders with the same legal representative or those having direct controlling or management relationships with each other shall not participate in procurement activities under the same contract; 2. Bidders providing comprehensive design, specification preparation, or services such as project management, supervision, or testing for the procurement project shall not participate in the procurement activities of that project; 3. Bidders listed on the “Credit China” website as untrustworthy persons subject to enforcement or parties involved in major tax violation cases, or listed on the “China Government Procurement Website” as being recorded for serious violations of integrity in government procurement (whose penalty periods have not yet expired), shall not participate in the government procurement activities for this project. 1. Suppliers must, within the specified registration period, use a CA key to register online via the electronic trading system on the Jiangxi Provincial Public Resources Trading Platform (http://www.jxsggzy.cn/web/), and download the consultation documents online. Any consequences resulting from failure to register as instructed in “Section 3: Obtaining Competitive Consultation Documents” of the consultation announcement shall be borne by the supplier itself. 2. For details on registration on the Jiangxi Provincial Public Resources Trading Website and procedures for obtaining the Jiangxi CA digital certificate, please refer to the “Notice on Collecting Information on Bidding Enterprises Nationwide for Jiangxi Provincial Government Procurement,” jointly issued by the “Jiangxi Provincial Government Procurement Website” (website: http://www.ccgp-jiangxi.gov.cn/web/) and the “Jiangxi Provincial Public Resources Trading Website” (website: http://www.jxsggzy.cn/web/), as well as the “Notice on Procedures for Obtaining Digital Certificates and Electronic Signatures for the Public Resources Trading System.” 3. In accordance with the relevant provisions of the “Provisional Measures for Electronic Government Procurement Management in Jiangxi Province,” suppliers must register on the Jiangxi Provincial Public Resources Trading Website and obtain both the Jiangxi CA digital certificate and an electronic signature. 4. Special Reminder: (1) This project adopts a “non-face-to-face bid opening” system. All suppliers do not need to attend the bid opening venue and must be proficient in operating the Xindian system. Any consequences arising from unfamiliarity with the system shall be borne by the supplier itself. During the bid opening and evaluation periods, the authorized representative must remain online at all times to receive inquiries and other information from the evaluation committee through the “non-face-to-face bid opening” system and respond to such inquiries in the “Interactive Communication” section (responses must be completed within 20 minutes of the inquiry being sent). Failure to respond within the stipulated time will be deemed as a waiver of the right to explanation and full acceptance of the experts’ opinions. When responding to inquiries, suppliers must print out the inquiry content and their responses, affix the official seal of their organization, scan the documents, and upload them to the “Interactive Communication” section (the response format shall follow the inquiry letter format issued by the procurement agency). (2) Before the bid deadline, all suppliers must complete online check-in on the “non-face-to-face bid opening” system page; otherwise, they will not be able to proceed to the subsequent bid opening stage. If a supplier fails to check in online before the bid deadline, their bid will be deemed invalid. If fewer than three suppliers register for the project, the tender will be declared void. (3) Response Document Unlocking Time: After the procurement agency announces the start of unlocking, all suppliers must complete the unlocking process within 20 minutes. If a supplier fails to complete the unlocking within the prescribed time, the unlocking will be considered invalid, and the system will return the supplier’s response document, treating it as an invalid bid. (4) During the consultation phase of this project, the second-round bidding time must not exceed the time limit set by the consultation panel (20 minutes). Once the system displays “End of Bidding,” no further bids can be submitted. Units that fail to submit a bid will not be included in the final ranking. If a unit’s bid is invalidated, it will also be ineligible to submit a bid and will not be included in the ranking either. (5) If a supplier has objections to the bid opening process or the evaluation results, it may submit its objection in writing, affix the official seal of its organization, and scan and upload it to the ‘Bid Opening Objection Text Question’ section of the non-face-to-face bid opening hall for this project. (6) Handling of Unexpected Situations: If any of the following circumstances occur at the bid opening venue, causing the system to malfunction or making it impossible to ensure fairness, impartiality, and information security during the transaction, the purchaser, procurement agency, and trading center shall be exempt from liability: ① The electronic service or trading system server for the bid opening project experiences a failure, making the website inaccessible or the system unusable; ② Errors occur in the software or network database of the electronic service or trading system for the bid opening project, preventing normal operation; ③ The system has security vulnerabilities posing potential risks to confidential information; ④ A virus outbreak on the operating server causes the system to malfunction; ⑤ A power failure prevents the trading system from functioning; ⑥ Other force majeure events (such as earthquakes or floods) prevent the bid opening activity from proceeding normally. If any of the above situations occur and cannot be resolved promptly, the project implementing entity, regulatory authorities, and trading center shall promptly negotiate a solution. The following measures may be adopted: (1) If the system or network failure can be resolved within three hours, the bid opening will not be suspended, and the bid opening will resume once the system is restored within three hours. (2) If the system or network failure cannot be resolved within three hours, the bid opening will be suspended, and a notice of suspension will be published on the Jiangxi Provincial Public Resources Trading Website and the Jiangxi Provincial Government Procurement Website. The rescheduled bid opening date will be announced separately after the system is restored.
